OSHA Clarifies Application of “Forklift” Rule

This summer, APA learned that the state of Pennsylvania had interpreted the federal Occupational Safety and Health Administration’s new operator training rule regarding “Powered Industrial Trucks”—generally taken to mean forklifts and similar machines—to apply to skidder operators and other operators of in-woods logging equipment.  We immediately contacted OSHA Head Charles Jeffress with an opposing view and asked for clarification.  In late August, Richard Fairfax, OSHA’s Director of Compliance Programs, informed us that Pennsylvania OSHA’s interpretation was in error.  According to Mr. Fairfax, the existing OSHA logging standard’s training requirements for forestry-related machines (found in section 1910.266(i)(3)(ii)) are still the authority, although “employers may find it useful to consult the general standard for industrial truck operator training for additional guidance when developing training programs.”
