California: "Old Growth" Protection On September 12, the California Board of Forestry voted to adopt a rule that would prohibit the harvest of any tree on private land in the state germinated before 1800 without a state-approved environmental review. The regulation, apparently passed to head off a ballot referendum which would prohibit outright the harvest of trees dating from before 1850, calls for timber owners seeking to fell "old growth" trees to have a state-registered forester prepare a report assessing the trees' wildlife and ecological value. The Board of Forestry characterizes the rule as closing a "loophole" in current regulations. Proponents of the ballot referendum, meanwhile, say they will continue with their campaign.
