Appealing Road Deconstruction On September 29, the Northwest Forestry
Association and industry co-plaintiffs appealed Forest Service plans
to decommission a logging road on Siskiyou National Forest on the
grounds that the agency had failed to survey for 77 rare plants,
fungi, and animals. NFA
submits that decommissioning a road falls under Judge William
Dwyer’s injunction last month, which had stipulated that under the
terms of the Northwest Forest Plan, the Forest Service must complete
rigorous Endangered Species surveys prior to undertaking any “ground
disturbing activity.” Removing
a logging road certainly disturbs ground. NFA has explicitly stated that its purpose in filing the suit is not to prevent the agency from getting essential work done but to demonstrate the vagueness and breadth of Judge Dwyer’s ruling and to point out that logging is not the only management activity on federal land.
